one inch flowage diameter, through said adjoining land on to the stream running through said land for the purpose of drawing and using water from said stream for use in operating said quarry. The said party of the second part to lay said pipe under ground so as not to interfere with the plowing and cultivating said land and to level said ground after said pipe is laid by placing the earth, with surface soil on top, back in said trench used in laying said pipe. The said party of the second part to have the privilege of passing over said land where said pipe may be laid on to said stream for any necessary purpose in connection with the use of the same doing no more damage than is unavoidable in the laying, maintaining, and said using said pipe, or in passing over said land. And for said lease and privileges, as aforesaid, the party of the second part shall pay to the said Catharine Shifler the sum of Twenty-Five Dollars each year in advance, beginning on the First day of July A.D. 1902. And the payment of the sum of Twenty-Five Dollars on or before the 10th day of each succeeding July in each year shall renew and entitle the said party of the said second part to all the privileges and uses, as above set forth, for another year from the said First day of such July; not, however, exceeding the period of seven years in all including the said first year. The failure to pay said Twenty-Five Dollars in any year, as above, said lease and privileges shall thereupon cease and determine and the said party of the second part shall thereupon remove said guys and building from said land, together with the privilege of using water from well for drinking purposes.
